Criminal traffic law
Criminal traffic law affects all road users, regardless of how they travel on the road. Interference in road traffic can occur from the inside or from the outside. The relevant offenses are regulated in the German Criminal Code (StGB) in the Road Traffic Act (StVG)
What is the purpose of criminal traffic law
The main aim of criminal traffic law is to ensure road safety. Dangers to the legal interests of other road users should be excluded. Anyone who has ever been involved in an accident knows how serious the consequences can be.
Which offenses fall under criminal traffic law
Many criminal offenses and violations in criminal traffic law are considered minor, especially among private vehicle owners, and are usually only punished with a fine. These include administrative offenses such as exceeding the speed limit as well as obstructing other road users, for example by stopping in a no-parking zone or on the road. The extent to which a criminal or administrative offense is actually punished is often also a question of the severity of the offense. Drunk driving may result in a fine, while the negligent homicide of a person in road traffic due to drunk driving can lead to a prison sentence. The following offenses are frequently encountered as a criminal defense lawyer: Unauthorized removal from the scene of an accident, negligent bodily injury or homicide, failure to render assistance after accidents, violation of the Compulsory Insurance Act, endangering road traffic, drunk and drugged driving, dangerous interference with road traffic, driving without a valid driver’s license
What consequences can violations have
Since criminal traffic law always involves some kind of vehicle being used or involved in the situation, every offense carries the threat of a driving disqualification or a driving ban. This sanction is specific to the subject area and is intended to prevent a repetition of the offense. In many cases, however, it also impairs the defendant’s professional activity. We represent you as a client and advise you on your options if, for example, a medical-psychological examination is ordered to test your fitness to drive. Simple traffic offenses are often only entered in the driving fitness register if the trial goes well. In the case of serious offenses, however, especially if a prison sentence is imposed, criminal traffic offenses can lead to an entry in the Federal Central Criminal Register
